If a chartered ship goes alongside a berth at which the ship gets damaged, whose liability is it – owners’ or charterers’?

Damage done to either ship or quay at an unsafe berth is usually owners’ liability, not charterers’ (although some courts have held the reverse to be the case). It is always best to assume that the shipowners will be liable.
