In what work situations may the COSHH Regulations, as amended in 2004, still apply to the activities of the master or crew of a ship, or their employer?

If the activities are not carried out solely by the crew under the direction of the master and are liable to expose persons other than the master and crew to risk to their health and safety. Examples might be where shore-based contractors are carrying out fumigation or repairs or maintenance work on board. (Possibly for this reason, the Safety Management System of many UK shipowners and operators still requires compliance with COSHH. )
