What is a condition?

An important contractual term that goes right to the root of a contract, and so fundamental that breach of it by a party would frustrate the whole contract and make further performance impossible, giving the injured party the right to repudiate the contract and sue for damages. For example, it is a condition in every voyage charter that the chartered vessel will arrive and be fully at the charterer’s disposal at the agreed loading port not later than the cancelling date.
