Has the cargo been delivered once it has been discharged?

Not necessarily. 

The cargo may lie in a terminal, e. g. a stockyard, tank farm, car parking lot, container compound, etc. and still be in the carrier’s constructive possession. Goods are not legally delivered until they are handed over to the consignee or his receiver.
